Was the Punishment Harsh Enough?

Animal advocates in the Capital Region are angry and frustrated over what they believe was an extremely lenient sentence in a disturbing Columbia County horse cruelty case.

Andrea Nussinow of Blue Star Farms in Tivoli was found guilty in June on three counts of animal cruelty after investigators discovered troubling conditions involving horses on the property.

According to NewsChannel 13, investigators said barn stalls were clogged with manure and debris, several horses were emaciated or sick, at least one horse had an open leg wound, and the barns lacked proper ventilation.

Thirteen horses were removed in 2024, and two horses were ultimately euthanized.

Nussinow was sentenced to three years' probation, 100 hours of community service, and $1,750 in fines and fees.

Local SPCA Wanted More Punishment

But the Columbia-Greene Humane Society/SPCA says that punishment falls painfully short.

President and cruelty investigator Ron Perez praised both New York State Police and the Columbia County District Attorney's Office for their work investigating and prosecuting the case.

But his major issue, according to the Facebook post, is what happened afterward.

Perez called the sentence “very, very lenient,” adding that it wasn't even a “slap on the wrist,” but a “tap on the wrist.”

Nussinow May Own Three Horses in the Future

The SPCA is particularly upset about a provision that could eventually allow Nussinow to possess horses again. According to the organization, Judge John Connor Jr. ruled that she could petition the court after three years for permission to have up to two horses.

Prosecutors reportedly objected to that provision.

The SPCA says the sentence sends the wrong message about the seriousness of animal cruelty and worries about what it could mean for animals in the future.

“The animals deserve better,” the organization wrote. “So does the justice system.”
