State Police Charge Operator With DWI Following ATV Accident Involving Child Passenger
A New Hampshire woman has been arrested following the investigation into the case of an All Terrain Vehicle (ATV) crash involving a child passenger.
New York State does not have an age limit for passengers on an ATV but according to New York State Department of Health, the state does govern how and when passengers are allowed. For example, the ATV must be built to carry more than 1 person and all riders, regardless of age, must wear an approved protective helmet at all times.

On Sunday July 5th New York State Police in Chatham were dispatched to a reported ATV rollover in the area of Mahar Road and Frees Road in the town of New Lebanon.
ATV accidents are not to be taken lightly. In 2003, for example, Ozzy Osbourne suffered a near-fatal ATV accident at his estate in Buckinghamshire, England. In that incident, Ozzy hit a bump, went down an embankment, the vehicle flipped and landed on top of him.
The New Lebanon investigation revealed that the suspect was operating an ATV with a child passenger when she lost control, causing the ATV to overturn and slide before coming to a stop. Neither the operator or the child was wearing a helmet. The child passenger was not injured.
On October 8, 2026, according to a press release, New York State Police arrested 57-year-old Theresa Langevin of Milford, New Hampshire. Langevin is charged with Aggravated Driving While Intoxicated with a Child Passenger Less Than 16 Years of Age, and Operating a Motor Vehicle While Impaired by Drugs.
